.UK DOMAIN REGISTRATION TERMS & CONDITIONS

1. Definitions

“We”, “Us”, “Our” refers to NSM Sidcup Ltd trading as NSM I.T SERVICES, the registrar or reseller providing .uk domain registration services.
“You”, “Your” – refers to the customer or registrant of the domain name.
“Nominet” – refers to Nominet UK, the official registry for .uk domain names.
“Domain” – refers to the .uk domain name registered, renewed, or managed by us on your behalf.

2. Your Agreement with Us and Nominet

• When you register or manage a .uk domain through us, you enter into two separate agreements:

1. A contract with NSM Sidcup Ltd trading as NSM I.T SERVICES (These Terms).
2. A contract with Nominet UK, which governs all .uk domain names.

• Nominet’s Terms can be viewed at: https://www.nominet.uk/uk-domains/policies/
• You must agree to both our Terms and Nominet’s Terms before we can complete any .uk domain registration or renewal.

3. Registration Process

• Domain registrations are carried out on a first-come, first-served basis.
• You are responsible for ensuring that:
• The information you provide is accurate and complete.
• You have the right to register and use the chosen domain name.
• We will submit your registration request to Nominet once full payment and confirmation of details are received.
• We do not guarantee that your requested domain name will be available or successfully registered until Nominet confirms it.

4. Domain Renewals

• You will be contacted by email approximately 30 days before your domain’s expiry date to remind you of renewal.
• It is your responsibility to ensure your contact details are up to date so renewal notices are received.
• Renewal fees must be paid before the expiry date to maintain ownership.
• If a domain is not renewed, it will expire and eventually be released for public registration by Nominet.
• Domains are typically registered and renewed for a minimum term of one year.

5. Domain Transfers

• You may transfer your .uk domain to another Nominet registrar by requesting an IPS Tag change.
• To transfer your domain away:
• Contact our support team via support@nsmit.co.uk.
• Provide your domain name, account details, and the new registrar’s TAG.
• We aim to process transfer-out requests within 2 working days of receiving all required information.
• No administrative charge is applied for domain transfers out.
• Transfers to our TAG can be initiated by contacting our support team.

6. Domain Management & Ownership

• The domain will be registered in your name (the registrant), unless otherwise agreed.
• You are responsible for ensuring the domain is not used for illegal, abusive, or infringing purposes.
• We reserve the right to suspend or cancel a domain if:
• Required by law or Nominet.
• It is used for abuse (e.g., spam, phishing, malware).
• It breaches our Acceptable Use Policy or Nominet’s Terms.

7. Pricing and Payment

• All prices are quoted directly and provided in writing.
• Payment is required in full prior to registration, renewal, or transfer.
• If payment is not received, the domain registration or renewal will not proceed.

8. Abuse and Misuse of Domains

We take online abuse seriously.
If you believe a domain registered or managed by us is being used for abuse (e.g., phishing, spam, fraud, malware), please report it immediately to abuse@nsmit.co.uk

We will acknowledge all abuse reports within 1 working day and investigate promptly, taking appropriate action as required by Nominet and UK law.

9. Complaints and Dispute Resolution

If you are unhappy with any aspect of our domain registration services, please contact our complaints team complaints@nsmit.co.uk.

We will:

• Acknowledge your complaint within 2 working days, and
• Aim to provide a full response within 5 working days.

If your complaint relates to a .uk domain name and remains unresolved, you may escalate it to Nominet UK at: https://www.nominet.uk/complaints/

Domain disputes are handled through Nominet’s Dispute Resolution Service (DRS): https://www.nominet.uk/domain-disputes/

10. Cancellation Policy

• You may request cancellation of your domain at any time by contacting domains@nsmit.co.uk.
• Cancellations are subject to confirmation of your identity and domain ownership.
• Once cancelled, the domain will be deleted from the Nominet registry after any applicable grace period and become available for public registration.

11. Data Protection

• We process your personal data in accordance with our Privacy Policy and applicable UK data protection laws.
• Registration details may be shared with Nominet and published in WHOIS data in accordance with Nominet’s privacy rules.

12. Limitation of Liability

• We are not liable for any indirect, special, or consequential loss resulting from domain registration, suspension, or failure of renewal.
• Our total liability shall not exceed the amount paid for the domain service in question.
• Nothing in these Terms limits your statutory rights or our liability for death, personal injury, or fraud.

13. Termination and Suspension

We reserve the right to suspend or terminate domain services if:

• You breach these Terms or Nominet’s Terms;
• You fail to pay any fees due;
• The domain is used for unlawful purposes.

14. Changes to These Terms

We may update these Terms from time to time to reflect legal, operational, or policy changes.
Any changes will be published on our website and take effect immediately upon posting.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.
Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
